Terms of Use

Welcome to OpenAyah. These Terms of Use ("Terms") govern your access to and use of the OpenAyah mobile application ("App"), operated by Kitaby LTD ("we," "us," or "our"). By downloading, installing, or using OpenAyah, you agree to be bound by these Terms.

1. Eligibility

To use OpenAyah, you must:

• Be at least 13 years of age (or 16 in the European Economic Area)
• If under 18, have permission from a parent or legal guardian
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet these eligibility requirements. If you are a parent or guardian permitting a minor to use the App, you agree to be bound by these Terms on behalf of that minor and are responsible for their use of the App.

2. Account Registration

2.1 Creating an Account

While some features of OpenAyah can be used without an account, certain features require you to create an account. You can sign up using:

• Apple Sign-In (with optional private relay for email privacy)
• Google Sign-In
• Email magic link (passwordless authentication)

2.2 Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

2.3 Account Deletion

You may delete your account at any time through:

• In-app: Settings → Account → Delete Account
• Email: Contact support@kitaby.app

When you delete your account, all associated data (bookmarks, notes, reading progress, and analytics) will be permanently deleted from our servers within 30 days.

3. App Description and Features

3.1 What OpenAyah Provides

OpenAyah is an Islamic reading companion that provides:

• Quran Reading: Complete Quran text in Arabic (Uthmani and Indo-Pak scripts), English translations, and Tafsir (Islamic exegesis)
• Hadith Collections: Six major hadith collections (Bukhari, Muslim, Tirmidhi, Abu Dawud, Nasai, Ibn Majah)
• Audio Recitation: Quran recitations with word-level synchronization
• Reading Progress: Track verses read, reading streaks, and Quran completion (Khatm)
• Reading Goals: Create personalized reading goals with progress tracking
• Bookmarks and Notes: Save verses and add personal annotations
• Search: Full-text search of Quran and Hadith (processed entirely on your device)
• Prayer Times: Based on your device timezone
• Cross-Device Sync: Sync your progress across devices with an account

3.2 Offline Functionality

OpenAyah is designed to work offline. The following features work without an internet connection:

• Reading Quran text, translations, and Tafsir
• Browsing and searching Hadith collections
• Viewing saved bookmarks and notes
• Tracking reading progress locally
• Searching (all searches are processed on-device)

Internet connection is required for: account sign-in, syncing data to the cloud, streaming audio recitations, and subscription verification.

4. Subscriptions and Payments

4.1 Free and Premium Features

OpenAyah offers both free features and optional premium subscriptions. Core Quran and Hadith reading functionality is available for free.

4.2 Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your device's account settings (App Store or Google Play)
• Free trial periods (if offered) will automatically convert to paid subscriptions unless cancelled

4.3 Refunds

Refund requests must be directed to Apple or Google, as they handle all payment processing:

• Apple: Request a refund from Apple
• Google: Request a refund from Google Play

We do not have the ability to process refunds directly.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for subsequent billing periods and you will be notified in advance as required by the app stores.

5. User Content

5.1 Your Content

"User Content" refers to any content you create within the App, including:

• Bookmarks
• Personal notes and annotations
• Reading goals

5.2 Ownership

You retain ownership of your User Content. By creating User Content in OpenAyah, you grant us a limited license to store and sync your content solely to provide you with the App's functionality. We will not share, sell, or use your User Content for any other purpose.

5.3 Your Responsibility

You are solely responsible for your User Content. Your personal notes and annotations are private to your account and are not shared with other users.

5.4 Backup

While we take reasonable measures to protect your data, we recommend keeping local backups of important notes. You can request an export of your data by contacting us.

6. Intellectual Property

6.1 App Ownership

The OpenAyah application, including its design, user interface, code, features, and branding, is owned by Kitaby LTD and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App without our written permission.

6.2 Religious Content

The Quran and Hadith texts are religious scripture that belong to humanity. Our presentation, formatting, translations, and curation of this content, as well as our databases and audio synchronization, represent our intellectual property. The underlying religious text itself is not claimed as proprietary.

6.3 Third-Party Content

Audio recitations are provided by third-party reciters and sourced from Quran.com. Tafsir content is from established Islamic scholarship. We respect the intellectual property of all content creators.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use this feedback without compensation or attribution to you.

7. Acceptable Use

You agree to use OpenAyah only for lawful purposes and in accordance with these Terms. Acceptable uses include:

• Personal reading, study, and memorization of Quran and Hadith
• Tracking your personal reading progress
• Creating bookmarks and notes for personal reference
• Listening to Quran recitations for personal spiritual benefit
• Setting and tracking reading goals

8. Prohibited Conduct

You agree NOT to:

• Reverse engineer: Decompile, disassemble, or attempt to derive the source code of the App
• Scrape or bulk download: Use automated means to extract content from the App
• Circumvent security: Attempt to bypass any security measures or access controls
• Interfere with the App: Introduce viruses, malware, or disrupt the App's functionality
• Impersonate others: Create accounts using false identities or others' credentials
• Commercial exploitation: Use the App's content for commercial purposes without permission
• Violate laws: Use the App for any illegal purpose
• Abuse the system: Manipulate reading statistics or exploit bugs for unintended benefits

Violation of these prohibitions may result in immediate termination of your account and access to the App.

9. Third-Party Services

OpenAyah uses the following third-party services to provide functionality:

Cloudflare	Content delivery for language packs

These services have their own terms of service and privacy policies. We are not responsible for the practices of these third-party services. Your use of OpenAyah is also subject to the terms of the Apple App Store or Google Play Store.

10. Disclaimers

10.1 "As Is" Basis

10.2 No Religious Authority

OpenAyah is a reading and study tool, not a religious authority. The translations, Tafsir, and other interpretive content are provided for educational purposes. For authoritative religious guidance, please consult qualified Islamic scholars.

10.3 Content Accuracy

While we strive to ensure the accuracy of Quran and Hadith texts, we do not warrant that the content is error-free. The Arabic Quran text is sourced from established digital manuscripts, but we encourage verification with physical Mushafs for critical study.

10.4 Service Availability

We do not guarantee that the App will be available at all times. We may experience downtime for maintenance, updates, or circumstances beyond our control.

10.5 Third-Party Content

Audio recitations are provided by third parties. We do not control and are not responsible for the quality, accuracy, or availability of third-party audio content.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• Kitaby LTD and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the 12 months preceding the claim (or £50, whichever is greater)
• We are not liable for any loss of data, even if we have been advised of the possibility of such loss

Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kitaby LTD, its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

13. Termination

13.1 Termination by You

You may stop using OpenAyah at any time by uninstalling the App. If you have an account, you may delete it as described in Section 2.3.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to OpenAyah at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Conduct that harms other users or the App
• Extended periods of inactivity

13.3 Effect of Termination

Upon termination:

• Your license to use the App is immediately revoked
• You must cease all use of the App
• We may delete your account data (or retain it as required by law)
• Sections of these Terms that should survive termination will remain in effect

14. Changes to Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last Updated" date at the top
• We will notify you via email (if you have an account) or in-app notification
• Continued use of the App after changes constitutes acceptance of the new Terms

If you do not agree to the updated Terms, you must stop using the App and delete your account.

15. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of England and Wales, except where prohibited by law.

If you are a consumer in the European Union, you may also bring proceedings in your country of residence, and you retain the protection of mandatory consumer protection laws of your jurisdiction.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kitaby LTD regarding your use of the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights to any affiliate or successor.
