Welcome to OpenAyah. These Terms of Use ("Terms") govern your access to and use of the OpenAyah mobile application ("App"), operated by Kitaby LTD ("we," "us," or "our"). By downloading, installing, or using OpenAyah, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree to these Terms, do not use the App. Your continued use of OpenAyah constitutes acceptance of these Terms and any updates we make to them.

4. Subscriptions and Payments

4.1 Free and Premium Features

OpenAyah offers both free features and optional premium subscriptions. Core Quran and Hadith reading functionality is available for free.

4.2 Subscription Terms

Important: All subscriptions are billed through the Apple App Store or Google Play Store. We do not process payments directly.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for subsequent billing periods and you will be notified in advance as required by the app stores.

"User Content" refers to any content you create within the App, including:

You retain ownership of your User Content. By creating User Content in OpenAyah, you grant us a limited license to store and sync your content solely to provide you with the App's functionality. We will not share, sell, or use your User Content for any other purpose.

You are solely responsible for your User Content. Your personal notes and annotations are private to your account and are not shared with other users.

5.4 Backup

While we take reasonable measures to protect your data, we recommend keeping local backups of important notes. You can request an export of your data by contacting us.

6. Intellectual Property

6.1 App Ownership

The OpenAyah application, including its design, user interface, code, features, and branding, is owned by Kitaby LTD and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App without our written permission.

6.2 Religious Content

The Quran and Hadith texts are religious scripture that belong to humanity. Our presentation, formatting, translations, and curation of this content, as well as our databases and audio synchronization, represent our intellectual property. The underlying religious text itself is not claimed as proprietary.

6.3 Third-Party Content

Audio recitations are provided by third-party reciters and sourced from Quran.com. Tafsir content is from established Islamic scholarship. We respect the intellectual property of all content creators.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use this feedback without compensation or attribution to you.

You agree to use OpenAyah only for lawful purposes and in accordance with these Terms. Acceptable uses include:

These services have their own terms of service and privacy policies. We are not responsible for the practices of these third-party services. Your use of OpenAyah is also subject to the terms of the Apple App Store or Google Play Store.

10. Disclaimers

10.1 "As Is" Basis

OpenAyah is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

10.2 No Religious Authority

OpenAyah is a reading and study tool, not a religious authority. The translations, Tafsir, and other interpretive content are provided for educational purposes. For authoritative religious guidance, please consult qualified Islamic scholars.

10.3 Content Accuracy

While we strive to ensure the accuracy of Quran and Hadith texts, we do not warrant that the content is error-free. The Arabic Quran text is sourced from established digital manuscripts, but we encourage verification with physical Mushafs for critical study.

10.4 Service Availability

We do not guarantee that the App will be available at all times. We may experience downtime for maintenance, updates, or circumstances beyond our control.

10.5 Third-Party Content

Audio recitations are provided by third parties. We do not control and are not responsible for the quality, accuracy, or availability of third-party audio content.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

You agree to indemnify, defend, and hold harmless Kitaby LTD, its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kitaby LTD regarding your use of the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

16.4 Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights to any affiliate or successor.
